1. Agreement and governing law

These Terms of Service ("Terms") govern your access to and use of the Site operated for the benefit of BARS AI LTD. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer in your country of residence.

2. Definitions

  • "Company" means BARS AI LTD.
  • "Site" means the website available at barsagency.qa and related pages.
  • "User" means any person who accesses or uses the Site.
  • "Content" means text, graphics, logos, software, and other materials made available through the Site.
  • "Services" means professional services we may offer separately under a written agreement (these Terms primarily govern use of the Site).

3. Acceptable use

You agree that you will:

  • Comply with all applicable laws and regulations, including those of England and Wales and your location
  • Provide accurate information when you contact us or submit forms
  • Not attempt to disrupt, damage, or gain unauthorised access to the Site or underlying systems
  • Not use the Site to distribute malware, conduct unlawful activity, or infringe third-party rights
  • Not scrape, harvest, or automate access to the Site in a way that impairs performance or breaches our rights

We may suspend or restrict access where we reasonably believe these rules are breached or where required by law.

4. Intellectual property

Unless otherwise stated, the Content is owned by the Company or its licensors and is protected by copyright, trade mark, and other intellectual property laws of the United Kingdom and international treaties. You may not copy, modify, distribute, sell, or lease any part of the Content without our prior written consent, except as permitted by applicable law or for temporary technical copying incidental to normal browsing.

5. Disclaimers

The Site and Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by English law, we disclaim all warranties (express or implied), including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement, except where such disclaimers cannot lawfully be excluded.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

6. Limitation of liability

Subject to section 5, to the fullest extent permitted by English law the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Site.

Subject to section 5, our total aggregate liability arising out of or relating to the Site and these Terms (whether in contract, tort (including negligence), or otherwise) shall be limited to the greater of (a) one hundred British pounds (£100) or (b) the amount you have paid us specifically for access to the Site in the twelve (12) months before the claim (if any such payment exists).

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 and related UK consumer legislation.

7. Third-party links

The Site may contain links to third-party websites. We are not responsible for the content or practices of third parties. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

8. Dispute resolution

We encourage you to contact us first so we can try to resolve concerns informally. If a dispute cannot be resolved, the courts of England and Wales shall have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you.

Alternative dispute resolution (ADR) may be available in the UK (for example through approved ADR providers). This does not restrict your right to bring proceedings before the competent courts.

9. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will change when a new version is published. Continued use of the Site after changes constitutes acceptance of the updated Terms, except where your separate consent is required by law.
